From now on there are two different completely revised application forms. When it was drawn up, suggestions from those affected, experts and those from the Sexual Abuse Fund were incorporated and implemented.

Affected people who have been sexually abused in their family environment use the "Application for assistance from the Fund for Sexual Abuse in Families" to apply.

Affected people who have suffered sexual abuse in an institutional setting use the "Application for assistance from the supplementary assistance system for the institutional sector" to submit an application.

People who are affected by sexual abuse in their family and in an institution can choose which of the two application forms they would like to use for the application. You can use the free fields (including "space for further explanations") to show that you are multiplely affected in the application.

 

The aim of the new application forms is to provide applicants with clear and transparent information about the assistance and the application process. It is specified exactly which documents should be attached to the application.

With the application form "Application for assistance from the Fund for Sexual Abuse in the Family", those affected by sexual abuse in the family can apply for assistance of up to 10,000 euros from the Fund for Sexual Abuse in the Family.

In addition, people with disabilities can apply for additional expenses of up to 5,000 euros, which are necessary and appropriate so that they can actually make use of the assistance (e.g. assistance, increased mobility costs).

Applications can still be made.

Who can apply for benefits?

Those affected who were sexually abused as children or adolescents, i.e. were minors at the time of the offense, are eligible to apply to the Fund for Sexual Abuse in the Family Area.

The time requirement is that the act occurred between May 23, 1949 (establishment of the Federal Republic) or October 7, 1949 (establishment of the German Democratic Republic) and before June 30, 2013 (the law to strengthen the rights of victims of sexual abuse came into force - StORMG) has been committed.

The local requirement is that the act was committed on the territory of the Federal Republic of Germany or the former German Democratic Republic.

Seeking advice

The network of counseling centers is continuously being expanded to provide advice and support with applications to the “Sexual Abuse Fund”. In every federal state there are specially trained advisors through the fund's office that those affected can turn to. Those affected can contact any advice center listed on the card.

Application procedure in the family area

The applicant or the authorized contact person specified in the application (hereinafter: contact person) will receive a confirmation of receipt and a personal anonymization number (PAN) from the office after the application has been submitted.

The office may ask applicants or the contact person if the application is incomplete. This is the case, for example, if not all signatures are available, the legal representation is unclear or information is completely missing that the clearing house urgently needs for advice (e.g. no information on the age, period of the act / s or the services requested).

The application will then be anonymized in the office if requested. This means that all personal data (name, address, insurance numbers etc. and names of other people from the personal environment as well as perpetrator names) are made unrecognizable. The applicant's personal data are only seen by a few employees of the office. The applications are kept locked in the office. At every step in the process, the office ensures that, apart from the employees entrusted with it, no one has unauthorized access to the applications and data.

In the Sexual Abuse Fund (FSM), applications are processed at different speeds by the FSM's office. This is due to the fact that inquiries about the applications are sometimes necessary and the office can decide independently on applications that do not present any difficulties in the factual or legal situation (publication with guidelines for the granting of benefits from the FSM from 12.12.2016) . The other applications will be submitted to the independent clearing house for consultation - anonymously if desired. When assessing each individual application, the office and clearing house observe the requirements of the guidelines on the granting of guidelines from the Fund for Sexual Abuse in the Family Area.

After the clearing house has discussed applications, the office reviews the decision for errors of judgment and compatibility with higher-ranking law as well as for compliance with the guidelines.

The office draws up and sends the performance decision to the applicant or the named contact person. The performance decision is an administrative act in the form of a notice.

If further information is required to assess the application, the office will ask the applicant or the contact person for this.

Applicants can object to a negative decision within one month of notification in writing or to be recorded at the Federal Office for Family and Civil Society Tasks, Auguste-Viktoria-Str. 118 in 14193 Berlin.

If facts and circumstances change after the decision has been made or during the processing time, this can be communicated to the office in writing, stating the PAN.

Due to the large number of applications received, the processing time is currently several months.

Affected people who were sexually abused in institutions in their childhood or youth can use the application form to apply for assistance up to EUR 10,000. The assistance requested by those affected is not financed from the Fund for Sexual Abuse in the Family Area, but is approved and paid for by the responsible institutions themselves. Institutional applications can only be processed if the institutions participate in the supplementary help system.

  • The German Child Protection Association (DKSB) (until further notice)
  • German Federal Pension Insurance (until December 31, 2021)
  • Free and Hanseatic City of Hamburg (until December 31, 2021)
  • State of Brandenburg (FRG) (until further notice)
  • Hessen (until further notice)
  • Evangelical Church Germany including Diakonie Germany (until December 31, 2023)

Negotiations are ongoing with institutions whose participation is currently still limited in time to extend or limit their participation. After such negotiations have been successfully concluded, the list will be updated immediately. You can therefore still submit an application if the participation of the institution concerned is about to expire. Overall, if deadlines have expired, an application can no longer be submitted again, but applications submitted before the deadline can still be processed.

The general requirements for applying for benefits from the supplementary support system in the institutional area are the same as those in the family area. For advice and support with the application, you can contact the advice centers on the card.

Application procedure in the institutional area

However, the application procedure in the family area differs significantly from the procedure in the institutional area. In the family area, the federal government approves the benefits that are financed from funds from the Sexual Abuse Fund in the family area. In the institutional area, the responsible institutions themselves approve and finance the services.

Applications in the institutional area are accepted by the Secretariat of the Fund for Sexual Abuse in the Family Area. Formally, it is an application to the institution.

Once the application has been received, the Fund's office may ask the applicant or the contact person if the application is incomplete or if it is not clear from the application in which institution the abuse took place.

Before the application can be sent to the institutions, the office asks for a separate declaration of consent from the applicants.

After the consent to the transmission has been given, in addition to the personal data of the applicant and other people from the personal environment of the applicant, as well as the names of the perpetrators (also in the case of abuse in the institutional area) are anonymized on the basis of data protection requirements. The anonymized application is then forwarded with a personal data sheet to the relevant institution for comment.

If necessary, the institution can ask the applicant or the contact person for the name of the perpetrator.

The institution's statement is sent to the administrative office together with the application.

The statement and the anonymized application are submitted to the members of the clearing house for a recommendation. The clearing house advises on each application individually in accordance with the requirements of the guidelines in the institutional area. These correspond to the requirements of the guidelines in the family area and were coordinated between the institutions, representatives of those affected and the federal government.

The decision on the application is made by the respective institution and informs the office of the result for forwarding to the applicant or the contact person.

If you, as the applicant, would like the service providers (e.g. therapist) to settle the services provided directly with us, we need your consent to the direct payment.

Please note that receipts must always be provided for invoicing by direct payment. In this case, the office needs proper invoices that comply with the legal requirements of the Value Added Tax Act. The payment will only be made as a transfer. Direct debits are not possible.

If you have been granted services from the fund as advance payments (e.g. towards the OEG), it is necessary that you assign to the fund any claims that you are granted under the OEG for the same services. This is necessary because the fund can only provide subordinate services. If there are priority claims - in this case your claims under the OEG - then these are to be used for the reimbursement of the benefits. The fund requires the declaration of assignment in order to have the payments made in advance reimbursed by the authority responsible for your OEG procedure.
